Overview
This privacy policy applies to the Uepaa app, Uepaas website and the processing or transfer of personal data carried out by Uepaa AG (“Uepaa”), Sonnhaldenstrasse 17, 8032 Zurich, in this context. Uepaa takes the protection of your personal data very seriously. In order for Uepaa to be able to provide its services in a customer-oriented and appropriate manner, it is dependent on being able to collect and process certain personal data. Uepaa complies with the provisions of Swiss data protection legislation. The following information provides information on how your personal data and information is handled.
1. Which personal data is processed?
Uepaa collects information in a variety of ways.
Some personal information is collected when you set up or change your profile. Uepaa will ask you for your name, a photo, gender, telephone number, year of birth and emergency contacts from your address book (including all their telephone numbers) and, if necessary, provide Uepaa with this information. After setting up or changing your profile, Uepaa may ask you for personal information on other occasions, such as when you use additional offers or when you report a problem with their service to Uepaa. In addition, data related to your smartphone or similar device (hereinafter also “telephone”) is processed, including the telephone model, the operating system, the MAC address, mobile telephone service provider or operator and the version of the Uepaa app.
If the Uepaa app is running, Uepaa collects the following data: location data, battery charge level GPS and/or network-based position (longitude, latitude, altitude, accuracy, speed) and total routes or tracks (i.e. tracking history); mobile telephone network (coverage, signal strength and type); alarm data (enriched alarm with all relevant data from your profile and the running Uepaa app, such as location/position and battery charge condition). Uepaa also collects and processes data about network coverage and performance (for various providers; GSM card).
Content generated by users (including you) is also distributed via Uepaa Net. As part of an alert and/or rescue operation, users can comment on and change existing rescue processes and interact with Uepaa, the victim and other Uepaa users. You hereby agree that such content will be sent to you.
As a user, you are constantly transmitting the above data to Uepaa Net (as defined and described in the terms of use) (so-called “messages”). Such messages can be generated either manually by a user action (e.g. alarm) or automatically in the background by the Uepaa app (e.g. position (longitude, latitude, altitude, accuracy, speed), battery charge status, network coverage and performance data). Messages are exchanged in the ways described in the terms of use under section II.B. You hereby agree that your smartphone may be used for Uepaa Net.
Uepaa carries out internal investigations into the interests and behavior of users based on the information that is available to Uepaa through registration and from its server log files (so-called log files). Uepaa does this in order to be able to offer its users improved services accordingly. These studies are compiled and analysed on a holistic basis.
The following data from Uepaa is stored on your phone: The Uepaa app, the version of the Uepaa app and other data relevant for maintenance and support.
You agree that the Uepaa app can access the following data or perform the following actions: (i) dial telephone numbers (including those from your address book) directly without your intervention; (ii) exact and/or approximate location (Uepaa app may determine your exact or approximate position and movement using GPS data, location services, network location sources such as transmission towers or WiFi).
Finally, you agree that Uepaa and/or the rescue organization may link the data collected in connection with the Uepaa app with existing data from rescue organizations, provided that it serves to efficiently plan and process operations or communicate with you.
2. For what purposes is personal data processed?
Uepaa collects and processes personal data in order to operate the Uepaa app in a customer-oriented and appropriate manner and also to be able to provide its services as well as for the purpose of using the Uepaa app by users. Uepaa processes personal data in particular (i) for the purpose of alerting and rescuing (in particular carrying out and verifying alarming and rescuing), (ii) to increase security, in particular by using users' smartphones for cloud communication services, (iii) to store and process information on the Uepaa server so that the alert and rescue process can be supported in emergency situations; (iv) so that users can be supported as part of an alert and/or rescue operation existing rescue processes comment on and modify or interact with Uepaa, emergency responders, the victim, and other Uepaa users; (v) so that users can communicate across the Uepaa Net; and (vi) for identification, billing and marketing purposes and to provide you with company, product, or other information that Uepaa believes may be of interest to registered users.
The user agrees that their personal information will be processed by Uepaa for marketing purposes. In particular, the data can be used for announcements of events, competitions and surveys as well as information about services and products from Uepaa and its partners.
Uepaa processes the above data and stores this data, such as log files with telephone model, telephone ID and signal strength, in order to improve its service and to be able to provide mobile phone providers with appropriate information (on an anonymous basis).
3. Which data is passed on to third parties and for which purposes?
In principle, Uepaa, emergency contacts, rescue organizations recognized by Uepaa as partners, rescue workers and rescue doctors, authorities and, as part of the communication of messages, other Uepaa users have access to the collected and processed personal data. In particular as part of, to carry out and verify alerts or rescue operations, emergency calls by the Uepaa user, as part of comrade assistance or by a third person, as well as missing reports or inquiries regarding potential or actual emergencies by authorities, rescue organizations, rescue workers or rescue doctors, it is possible that the personal data referred to in section 1 can be sent to other Uepaa users, rescue organizations, rescue workers and rescue doctors, as well as notified and/or accessible to authorities or other third parties are made, which in turn process them. The transmission of as complete and correct information about emergencies as possible using the Uepaa app enables authorities, rescue organizations, rescue workers and any rescue doctors to efficiently assess how to proceed. Insofar as personal data from other Uepaa users becomes available to you in this context, you hereby agree to process it only under the conditions set out in this privacy policy for the purpose of alerting and/or rescuing.
In addition, the data specified in Section 1 may be shared with Uepaa's commercial partners, such as advertising partners, for the purposes set out in Section 2.
Uepaa also reserves the right to process and share information and personal data with relevant civil and law enforcement authorities in order to comply with applicable laws, regulations, legal proceedings or criminal investigations. Uepaa also reserves the right to disclose information and personal data to third parties (i) if you have agreed, (ii) when Uepaa deems it necessary to provide you with the services contained in the Uepaa App; (iii) to protect the personal safety or rights of you, Uepaa, another user or third party; (iv) as part of corporate transactions.
Uepaa uses various service providers to help it improve the quality and performance of its service and business. This means that such third-party service providers have access to personal data and can process it for Uepaa. In particular, Uepaa uses “Amazon web service” from Amazon Web Services Inc., USA, and affiliated companies for its servers. Amazon Web Services Inc. processes the data on the basis of its privacy policy (http://aws.amazon.com/de/privacy), which you also hereby expressly agree to.
4. Is personal data transferred abroad?
It is possible that, particularly in the case of repatriation operations, personal data must be transferred to third countries where there is no level of data protection comparable with Swiss data protection legislation. By using this Uepaa app, the user agrees to this.
Uepaa's servers are generally located in Switzerland, Ireland and other countries of the European Union, in particular as part of the “Amazon web services” used by Uepaa. If Amazon Web Services Inc. or its affiliated companies are required to do so by law or as a result of requests from authorities, personal data may also be transferred to other countries, including countries (including the USA), which do not have data protection equivalent to Swiss data protection legislation. You hereby consent to the transfer of your personal data to such countries, in particular to the USA.
5. What correction, update and deletion options are available to the user?
Every user can edit and change their profile information within the Uepaa app at any time. For any other issues and to delete your profile, contact support@uepaa.ch.
6. What rights does the user have?
Every user has the right to edit their profile in accordance with section 5 of this statement and to correct it if necessary.
By law, every user has the following rights: (i) Right to Information; (ii) Right to Block Disclosure; (iii) Right to Correction; (iv) Right to Delete Personal Information.

to assert. For unique identification, a copy of the identity card or passport must be enclosed.
Uepaa reserves the right to charge an appropriate share of the processing costs incurred for the provision of information if (1) the requesting person has already been provided with the desired information in the twelve months before the request and no legitimate interest in providing a new information can be demonstrated; if (2) the provision of information involves a particularly large amount of work. The contribution amounts to a maximum of 300 francs.
7. What security measures are used to protect personal data?
Uepaa provides security measures to prevent loss, misuse, or alteration of information and personal data.
When exchanging messages (see section 1), SSL encryption is used for direct communication between the device and the Uepaa server. As soon as Uepaa has received transmissions, Uepaa adequately secures the information in its systems. Other communication is not encrypted.8.
